Terms of Service
These Terms of Service ("Terms") govern your use of realautomationagent.com (the "Site") and the automation consulting, build, and monitoring services (the "Services") provided by Real Automation Agent ("we," "us," or "our"), based in Hot Springs, Arkansas. By using the Site or Services, you agree to these Terms.
1. The Services
We design, build, connect, and monitor business automations, including AI-assisted workflows, for our clients. The specific scope, deliverables, timeline, and fees for any paid engagement are set out in a separate proposal, statement of work, or agreement ("Order"). If an Order conflicts with these Terms, the Order controls for that engagement.
2. Free audit
The free automation audit and any plan we send are general recommendations based on the information you provide. Time and cost savings shown are estimates, not guarantees. The audit creates no obligation for either party.
3. Your responsibilities
- Provide accurate information and the access needed to build and run your automations.
- Make sure you have the rights and permissions to connect the accounts and data you ask us to use, and that your use of automations (including emails and texts to your customers) complies with applicable laws, such as anti-spam, telemarketing, privacy, and industry-specific rules.
- Review and approve automations before they go live, and tell us promptly about changes to your business, tools, or accounts that could affect them.
- Keep your own account credentials secure.
4. Third-party services
Automations rely on third-party platforms (for example, Google, Microsoft, Netlify, n8n, Airtable, SMS providers, and AI model providers). Those services are governed by their own terms, and we are not responsible for their availability, changes, pricing, or outages. Some third-party costs may be billed to you directly or passed through as stated in your Order.
5. Fees and payment
Fees, billing schedules, and payment terms are set in your Order. Unless stated otherwise, invoices are due on receipt, and we may pause Services for overdue balances after notice.
6. Ownership
You own your data and your business content. After full payment, you receive the right to use the automations we build for your business. We keep ownership of our pre-existing tools, templates, know-how, and general methods, and may reuse non-confidential, general techniques for other clients.
7. Confidentiality and data
We keep your non-public business information confidential and use it only to provide the Services. We handle personal information as described in our Privacy Policy, including our commitments on Google user data.
8. Text messaging
If you opt in to texts from us, you agree to receive messages about your audit, bookings, and our services. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time, or HELP for help. Carriers are not liable for delayed or undelivered messages. Consent to texts is not a condition of purchase.
9. Acceptable use
You may not use the Site or Services to send spam, violate anyone's rights or privacy, break the law, or interfere with the Site's security or operation.
10. Warranties and disclaimers
We perform the Services in a professional and workmanlike manner. Otherwise, the Site and Services are provided "as is." Automations depend on third-party systems and can be interrupted by changes outside our control. We do not guarantee uninterrupted or error-free operation or any specific business result. AI-generated content can contain errors and should be reviewed where accuracy matters.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Site or Services is limited to the amount you paid us for the Services giving rise to the claim in the three months before it arose.
12. Indemnity
You agree to defend and indemnify us against claims arising from your data, your instructions, or your use of automations in violation of law or these Terms.
13. Termination
Either party may end an engagement as described in the Order, or with 30 days' written notice if the Order is silent. On termination, you pay for work performed through the end date, and we will disconnect our access and return or delete your data on request.
14. Governing law
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in or serving Garland County, Arkansas.
15. Changes
We may update these Terms by posting a new version on this page with a new "Last updated" date. Changes do not affect Orders already signed unless both parties agree.
